दिल्ली: दिल्ली की एक अदालत ने एक युवक को एक नाबालिग लड़की के अपहरण और बलात्कार के आरोपों से मुक्त कर दिया है। इसके फैसले के पीछे अदालत ने कहा है कि ऐसा कोई कानून नहीं है कि 18 साल की उम्र से कम होने पर कोई प्यार नहीं कर सकता। अदालत के मुताबिक किसी से प्रेम करना और उससे शादी करने की इच्छा रखना कोई अपराध नहीं है। किशोरी की उम्र 17 साल से अधिक है, लेकिन 18 साल से कम है। उसने अपने प्रेमी के साथ भाग कर मंदिर में शादी की और अब उसी के साथ रहना चाहती है।
कोर्ट का कहना है कि अगर कोई लड़का या लड़की एक-दूसरे से प्यार करते हैं और भाग कर शादी कर लेते हैं, तो शादी करने वाले युवक को केवल इसी आधार पर बलात्कार का दोषी नहीं ठहराया जा सकता कि लड़की नाबालिग है। देश के कानून में लड़की के विवाह के लिए उसकी उम्र कम से कम 18 साल होना जरूरी है।
अदालत ने अपने फैसले में कहा है कि नाबालिग होने के बावजूद लड़की की भावनाओं का सम्मान करने और परिवार और समाज से उन्हें अनुचित ठहराए जाने से बचाव का हक है। जहांगीरपुरी में रहने वाली इस किशोरी ने अपने प्रेमी के साथ भाग कर बरेली के एक मंदिर में शादी कर ली थी। लड़की के माता-पिता की शिकायत पर पुलिस ने अपहरण और बलात्कार का मामला दर्ज कर लिया था और युवक को गिरफ्तार कर लिया था।
अदालत ने इस मामले पर नाखुशी जाहिर करते हुए कहा कि कई मामलों में अदालतों के स्पष्ट फैसलों के बावजूद इस युवक को करीब 4 महीने जेल में गुजारने पड़े। पति की गिरफ्तारी के बाद किशोरी को बाल गृह में रखा गया क्योंकि उसने अपने माता-पिता के साथ जाने से मना कर दिया था। लड़की के माता-पिता इस शादी के खिलाफ इसलिए थे कि लड़का किसी और जाति का है।
